Can We Add a Credit Card Fee to Fuel App Orders?

Sometimes. Check state law, card-brand rules and your card-payment agreement first. A fee switch in an app does not give you permission to charge it. Visa allows some credit-card surcharges, with limits. It bars surcharges on Visa debit and prepaid cards. Take your proposed fee to your acquirer for review. Read Visa’s Q&A.

What does Visa’s published guidance require?

Visa’s U.S. Q&A says to give your acquirer at least 30 days’ notice. The cap is your merchant discount rate for the card or 3%, whichever is lower. Disclose the surcharge as a merchant fee. Alert customers at the point of entry and at the point of sale. Show the surcharge as a separate charge on every receipt. Read all of Visa’s terms. The version is dated February 15, 2024. Ask the acquirer to check the current rules. Do not use that document’s old state list as legal advice.

Which decision comes before the app setting?

Settle the fee policy before you change the screen. Your acquirer is the firm that manages card acceptance for your business. Ask how the payment flow checks card types. Have a lawyer check the states where you work. Then look at the fee, full total and receipt together. The name on a button does not settle the rules.

What should we bring to the screen review?

Bring the proposed fee, accepted payment methods and written approval to the screen review. Ask how the flow handles a card that cannot be surcharged. Use an internal test arranged with the provider. Keep real customer accounts and cards out of the demo. Get open questions answered before staff turn on the charge.

What should we check before launch?

Work through the fee policy before you enable a payment setting:

  1. Ask the acquirer to identify the card brands and current surcharge requirements for your account.
  2. Have counsel check the applicable state limits and disclosure wording.
  3. Document which card types are eligible and what the approved limit is.
  4. Review the displayed fee, total and receipt in an authorized test environment.
  5. Assign an office owner to recheck the policy when processing terms or state rules change.

Questions owners ask

Can we surcharge a Visa debit card run as credit?

No. Visa says a debit card stays a debit card even if the customer chooses credit at the terminal. Ask how your payment provider checks the card type. A checkout choice or the customer’s guess should not be the office’s way to decide which fee applies.

Does the product’s credit-card-fee guide settle legality?

No. The guide shows how to use a setting. It does not approve a charge for your business. Bring that guide to the acquirer and your lawyer. Ask them to review the actual payment flow, account terms and state rules before staff copy the setting into your app.

Should we copy another dealer’s fee?

No. Start with your own card agreement and the states where you work. Another dealer may have different terms. Write down why your policy was approved and who checked it. Give staff that record so they can explain a charge without guessing when a customer calls.

Is calling it a convenience fee enough?

No. A convenience fee and a surcharge can have different rules. Give your acquirer the facts of the payment and proposed charge. Ask which rules apply. Use the approved wording on the screen and show the full total before the customer chooses to pay.

What should we ask during a demo?

Ask to follow your approved fee from the card choice to the receipt. Include a card that cannot be surcharged. Find out which steps the processor handles and which your office sets. Name the person who must answer each open question before you turn on a fee.
