Can a Customer Order a Fill for a Propane Tank We Do Not Own?
Possibly. First check who owns the tank and whose permission your state requires. An app order alone does not prove the tank owner agreed. Pennsylvania, for example, requires container-owner authorization and Department authorization to transfer LPG. Emergency-response agencies may authorize a transfer instead. Send an uncertain account for review before dispatch. Read the Pennsylvania rule.
What does the Pennsylvania example require?
34 Pa. Code 13.8 covers LPG transfer and container use. For ordinary work, it requires container-owner authorization and Department authorization to transfer LPG. Department authorization covers the person doing the work; the rule does not call for a Department sign-off on each fill. An emergency-response agency may authorize a transfer instead. A person who transfers LPG or disconnects a container for an authorized emergency-response agency must notify the container owner within 5 days. Read the full state text. Do not apply this one-state example as the rule for every leased tank, small cylinder or emergency.
Which facts should the office establish?
Identify the tank, its owner and the proof of permission to fill it. The person in the house may not own the tank. The account holder may be someone else too. Have the office sort out those facts before dispatch. The driver should not have to settle an ownership dispute at the stop.
What does an ownership form prove?
A filled-out form gives the office facts to check. A customer’s answer does not prove ownership or grant rights that belong to someone else. Ask to see the completed form and where staff find it later. Have your lawyer or compliance lead define what further proof the account needs.
What should we check before launch?
Check ownership and permission before the order becomes a truck stop:
- Identify the delivery container and distinguish its owner from the property occupant.
- Check the applicable state container rule and any relevant agreement.
- Have the responsible reviewer confirm the required owner and regulatory authorization.
- Record the decision and supporting evidence in your approved account system.
- Tell dispatch whether the account is cleared or still needs office review.
Questions owners ask
Does owning the house mean owning the tank?
Do not assume it does. Ask for the facts the office needs to check who owns the tank. Have the person in charge review them. Keep property ownership and tank ownership separate on forms and in staff training. The account should show whose permission the company has checked.
Does a checkbox give us another dealer’s permission?
No. Treat the answer as a statement to review. It does not prove another owner gave your company permission. Ask your lawyer what proof fits the account and state. Keep the office’s decision with that proof before the order goes to dispatch for a fill.
Can we apply the Pennsylvania rule everywhere?
No. The citation is a Pennsylvania example. Check the law where the tank sits. Have the reviewer identify the rule and any exception that applies to this account. Keep the source with the office process so staff can see why the account was cleared for the work.
What should we ask about the app ownership form?
Ask what the customer sees and what comes back to the office. Try a case with unclear ownership, using no real customer details. Find the completed form later. Ask what staff must check next. Do not assume the form verifies title or supplies the owner’s permission on its own.
What if ownership is unclear when the order arrives?
Hold the dispatch decision for review. Assign one person to resolve the missing facts and record the result. Tell the customer which step comes next. An unanswered ownership question should not turn into an instruction to fill just because the order was paid or the app accepted it.
